This Digital Millennium Copyright Act ("DMCA") Policy outlines the process for reporting alleged copyright infringement on The Elliott Group’s websites and platforms (collectively referred to as “The Elliott Group”).The Elliott Group respects the intellectual property rights of others and expects its users to do the same. In compliance with the DMCA, we will respond to proper notices of alleged copyright infringement and take appropriate actions, including removing the infringing material and terminating accounts of repeat infringers where applicable.


1. Filing a DMCA Takedown Notice

If you believe that material available on The Elliott Group’s websites or services infringes your copyright, you may submit a DMCA Takedown Notice containing the following information:

Your Contact Information:

Your full name, address, telephone number, and email address.

Identification of the Copyrighted Work:

A description of the copyrighted work you claim has been infringed, including any registration details if available. If multiple copyrighted works are covered by a single notification, you may provide a representative list.

Identification of the Infringing Material:

The location of the material on our services that you claim is infringing (e.g., a URL or other specific location).

Statement of Good Faith:

A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

Accuracy and Authority Statement:

A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Your Signature:

A physical or electronic signature (typing your full name will suffice).

2. Counter-Notice Procedure

If you believe your content was mistakenly removed or disabled as a result of a DMCA Takedown Notice, you may submit a Counter-Notice. Your Counter-Notice must include:

Your Contact Information:

Your full name, address, telephone number, and email address.

Identification of the Material:

A description of the material that was removed or disabled and the location where it previously appeared.

Statement of Good Faith:

A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

Consent to Jurisdiction:

A statement that you consent to the jurisdiction of the federal court in the district where your address is located, or if you are outside of the United States, that you consent to the jurisdiction of the federal court located in Arizona.

Signature:

A physical or electronic signature (typing your full name will suffice).

Upon receipt of a valid Counter-Notice, we may reinstate the removed material unless the party who submitted the original DMCA Takedown Notice files a court action seeking to restrain the alleged infringement.
